PRAKTIK AKAD PRODUK KUR BSI MENURUT HUKUM ISLAM

Abstract

People's Business Credit (KUR) is a bank product that meets the needs of the community in the business sector, especially for micro, small, and medium enterprises (MSMEs). The purpose of MSMEs accessing KUR products is to develop their businesses. In practice, MSMEs involve third parties to meet their business development needs. Therefore, MSMEs utilize BSI's KUR product services. In the transaction between MSMEs and BSI, a Murabaḥah contract is used. In its implementation, BSI acts as a second party that purchases goods needed by MSMEs. In reality, MSMEs make purchases independently. In practice, this appears as if MSMEs are taking out a loan from BSI. This can be seen, as if MSMEs had funds, it would not be possible for them to involve BSI as a second party. Considering transaction practices like this, it is interesting to examine the extent to which these transactions comply with muamalah law. The methodology used was a descriptive method with a normative empirical approach, where empirical facts regarding KUR practices at BSI were analyzed using norms existing in Islamic economic law. In this study, it was found that BSI KUR uses the bay' Murabahah contract. The bay' Murabahah contract is used as a transaction between the bank and the customer to meet the customer's needs. To avoid usurious transactions in the form of debt, the bay' Murabahah contract is used.
